ARIZONA MARIJUANA-LEGALIZATION INITIATIVE DOESN'T LET CITIES BAN HOME CULTIVATION, CAMPAIGN INSISTS

Arizona has two competing marijuana legalization initiatives which have gained two different followings, but the legislation has some confused as to what exactly would be permitted and what cities would be able to ban. While one initiative has been considered too restrctive, the other, backed by Arizonans for Mindful Regulation, would allow for up to 1,600 dispensaries as opposed to 160. Many are worried that either initiative would come with the ability for cities to ban home cultivation under a nuisance provision, however the League of Arizona Cities and Towns has confirmed that cities will not be able to completely ban home grows as it is already established in the states medical marijuana law. 

Given the arguments by the two lawyers, similar gripes could be lodged about how smoking would be regulated under the CRMLA proposal. Dean says he believes it would not be reasonable under the initiative for a city to ban all indoor smoking of cannabis under the nuisance provision. But cities could conceivably restrict pot smoking in other ways, like prohibiting smoking it on an apartment balcony
