While we know that Arkansas has one of the harshest penalties for marijuana in the nation, some recent strides to legalize cannabis have failed. In 2020 advocates collected signatures for the Arkansas Recreational Marijuana Initiative which would legalize marijuana use for adults 21 and over; but unfortunately due to the COVID-19 pandemic, not enough could be collected. Luckily in 2016, Arkansas did legalize medical marijuana. So patients with certain qualifying conditions can legally medicate with cannabis with physician certification. Arkansas Medical Marijuana qualifying conditions include ALS, Alzheimer’s disease, Cachexia or wasting syndrome, Cancer, chronic or debilitating diseases, Crohn’s disease. Fibromyalgia, Glaucoma, Hepatitis C, HIV/AIDS, intractable pain, Multiple sclerosis, Peripheral neuropathy, PTSD, Seizures, severe arthritis, severe nausea, severe and persistent muscle spasms, Tourette’s syndrome, Ulcerative colitis or any medical condition or its treatment approved by the Department of Health. Medical marijuana patients can legally buy from any state-licensed dispensary, but patients under 21 cannot legally consume herbal forms of cannabis. Additionally, dispensaries cannot provide edible products filled with more than 10 mg of THC or any infused edible product that is marketed toward children. If you are not a medical marijuana patient, do not possess cannabis in Arkansas. If the police catch you possessing less than 4 ounces, you will be fined up to $2500 and serve up to a year in jail.
