In the nearly 10 years since Delaware legalized medical marijuana, a lot has changed in the industry and with public acceptance of cannabis. Hopefully, in the future, Delaware will officially legalize marijuana. Until then, we’ll just review its history. The Controlled Substances Act of 1970 made marijuana federally illegal, giving it a Schedule I label of highly addictive and of no medical use. It took several years, but finally, Delaware legalized medical marijuana in 2011. This means that patients diagnosed by a physician with Alzheimer’s disease, Amyotrophic Lateral Sclerosis (ALS), anxiety, cachexia, cancer, chronic pain (that has not responded to previously prescribed medication or surgical measures for more than three months), Cirrhosis, Epilepsy, Glaucoma, HIV/AIDS, intractable epilepsy, migraines, nausea, Post-traumatic Stress Disorder (PTSD), seizures, severe and persistent muscle spasms (including characteristics of multiple sclerosis) to possess up to 6 ounces of cannabis for medical purposes. Later in 2015, Delaware House Bill 39 (HB 39) decriminalized possession of up to one ounce of marijuana to only a $100 fine. In 2019, Delaware began a program that amended the state’s criminal code to expunge the records of people with one cannabis misdemeanor or felony. Finally, in 2020, Delaware was in the works to legalize recreational cannabis, but was unable to collect the signature to add it as a ballot initiative in the November election. Hopefully, in the future, Delaware will legalize as momentum for legal cannabis grows.
