Unfortunately, Florida’s state laws are historically anti-marijuana. It started back in 1933, when Victor Licata killed his family with an ax and the Tampa Police Department, the press and the first Commissioner of the Narcotics Bureau Henry Anslinger began making claims that smoking marijuana caused his mania. Despite Licata’s pre-existing mental health conditions, the yellow press of this era used this story to sensationalize “Reefer Madness.” In 2016 things changed when voters approved a medical marijuana program, allowing Florida residents diagnosed with any qualifying conditions to legally obtain a medical marijuana card. Qualifying medical conditions include: 

  • Amyotrophic lateral sclerosis (ALS)

  • Cancer

  • Crohn’s disease

  • Epilepsy

  • Glaucoma

  • HIV/AIDS

  • Multiple sclerosis (MS)

  • Parkinson’s disease

  • Post-traumatic stress disorder (PTSD)

  • Medical conditions of the same kind or class as or comparable to the others listed.

  • A terminal condition diagnosed by a physician other than the qualified physician issuing the physician certification.

  • Chronic nonmalignant pain due to a qualifying medical condition or that originates from a qualifying medical condition and persists beyond the usual course of that qualifying medical condition.

Unfortunately, those caught consuming marijuana without a medical marijuana card are subject to the United States’ harshest recreational marijuana laws. People possessing 20 grams of marijuana or less are subject to a misdemeanor with a $1000 fine and up to 1 year of imprisonment. Whether you just possess, use or sell the marijuana doesn’t matter, if it’s greater than 20 grams it is a felony and punishable by 5 to 30 years in prison.
